SC's Urgent Call: India's Justice System on the Brink?

In a stark warning that has reverberated across the nation, India's top court has declared it a 'crying need of the hour' to stem the alarming attrition of experienced judicial talent. The Supreme Court underscored that without immediate intervention, access to justice for millions would remain a mere chimera, an unattainable illusion, primarily due to a growing number of unfilled judicial posts across various courts.

This critical observation highlights a deep-seated crisis within the Indian judiciary. The continuous departure of seasoned judges, coupled with a sluggish appointment process, is creating an unprecedented void that threatens the very fabric of the justice delivery system. The Court's concern stems from the practical reality that an overburdened judiciary, short on experienced personnel, cannot effectively uphold the constitutional promise of swift and equitable justice for all citizens.

The States' Dismal Response

Adding to the gravity of the situation is the revelation that out of all states, a dismal only seven have responded positively to the Supreme Court's urgent 'SOS' regarding measures to retain judicial talent. Among these few responsive states are Tamil Nadu and Karnataka, indicating a widespread lack of proactive engagement from the majority of the country's administrative units. This apathy from states further exacerbates the problem, as judicial appointments and conditions are often a shared responsibility between the Centre and the states.

The Supreme Court's stern words are a direct challenge to state governments to acknowledge and address this looming crisis. Unfilled judicial vacancies lead to a ballooning backlog of cases, prolonging trials, and denying timely justice to litigants. This not only erodes public trust in the judiciary but also undermines the rule of law. The court's warning is a clarion call for immediate, concerted efforts to attract, retain, and adequately support judicial officers, ensuring that the wheels of justice continue to turn effectively for every citizen.
